Minnesotans Fight ICE With Snowballs

Correct me if Im wrong, but even with a license to conceal carry, Minnesota law states you cant do so in an area of declared civil unrest.

IDK if that's the case, but it would be stupid to do so, since so much can go wrong.

If one is rioting and armed with a dangerous weapon, depending on what happens, the charge could be Rioting First or Second Degree. The key word in the statute is "participant." Depending on what is going on, it can be difficult to determine who is a "participant," who had a lawful reason for being in the area and was involuntarily subsumed into the riot(ers), and who just ended up in the wrong place at the wrong time. Someone could be lawfully in an area going to or from work, school, the ER, etc., etc., etc.


2025 Minnesota Statutes​

609.71 RIOT.​


Subdivision 1.​


When three or more persons assembled disturb the public peace by an intentional act or threat of unlawful force or violence to person or property and a death results, and one of the persons is armed with a dangerous weapon, that person is guilty of riot first degree and may be sentenced to imprisonment for not more than 20 years or to payment of a fine of not more than $35,000, or both.

Subd. 2.​


When three or more persons assembled disturb the public peace by an intentional act or threat of unlawful force or violence to person or property, each participant who is armed with a dangerous weapon or knows that any other participant is armed with a dangerous weapon is guilty of riot second degree and may be sentenced to imprisonment for not more than five years or to payment of a fine of not more than $10,000, or both.

Subd. 3.​


When three or more persons assembled disturb the public peace by an intentional act or threat of unlawful force or violence to person or property, each participant therein is guilty of riot third degree and may be sentenced to imprisonment for not more than 364 days or to payment of a fine of not more than $1,000, or both.

(3) without unlawful purpose, but the participants so conduct themselves in a disorderly manner as to disturb or threaten the public peace.

aaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaand, if the riot, unlawful assembly, unrest, etc. is on Federal property, especially if it's posted, then Federal crimes, to include weapons violations, can be charged. In urban areas, such places are usually well posted, but out in the sticks, not always, or the sign(s) could be missing.

Earlier reports that Alex Pretti was holding a gun may have been incorrect.
Many people have been shot by LE when LE mistook a cell phone for a gun. This has been a problem for a long time.
Time will tell what really happened.

Judge grants restraining order against DHS after Border Patrol kills Alex Pretti in Minneapolis​

"Federal agents shot and killed a 37-year-old man in Minneapolis on Saturday morning, less than three weeks after an ICE agent fatally shot Renee Good and amid an ongoing surge in immigration enforcement action across the city.
U.S. District Court Judge Eric Tostrud granted a temporary restraining order against the U.S. Department of Homeland Security Saturday, barring the department from altering or destroying evidence connected to Pretti's killing.
Alex Jeffrey Pretti, an ICU nurse who worked at the Minneapolis VA hospital, was identified as the man killed by a Border Patrol agent. The Department of Homeland Security said the agent acted in self-defense after attempting to disarm Pretti, but Minnesota Gov. Tim Walz said that account was "nonsense" after reviewing videos of the shooting.
Videos from the scene show that Pretti was holding a cellphone, not a gun, when he was shot. An agent can be seen emerging from the scuffle with a gun and turning away from the man when the first shot is fired.

Bondi seeks Minnesota voter rolls, welfare data to "help bring back law and order" in wake of shootings​

"Attorney General Pam Bondi is pushing Minnesota Gov. Tim Walz to let the federal government access the state's voter rolls and public assistance data, as tensions flare in Minneapolis after a second person was shot Saturday by federal immigration agents assigned to a weekslong crackdown in the city.
In a three-page letter obtained by CBS News, Bondi also urged the state of Minnesota to scrap all "sanctuary" policies and "cooperate fully" with Immigration and Customs Enforcement, including giving the agency access to all local jails and honoring federal agents' requests to detain people."

At least Governor Walz and Mayor Frey are talking to President Trump/the White House.
Turns out there's both Immigration and Customs Enforcement (ICE) and Border Patrol here. ICE normally enforces immigration in the interior of the country. The two agencies are distinct and separate, but have similar/overlapping responsibilities. It was a Border Patrol Agent, who shot Pretti.


Commander Gregory Bovino, some Border Patrol agents set to leave Minneapolis, sources say​

"Border Patrol commander Gregory Bovino and some of his green-uniformed agents are expected to soon leave the Minneapolis area, three sources familiar with the move tell CBS News.
One of the sources said Bovino was relieved of his command in Minneapolis and is expected to return to California's El Centro sector, where he served as the chief agent before the Trump administration deployed him to major American cities, including Los Angeles and Chicago."

"News of Bovino's impending departure came hours after President Trump said Tom Homan, the White House border czar, would be heading to Minnesota.

"Federal agents on Saturday in Minneapolis fatally shot Alex Prett, who Minnesota officials say had a permit to carry. In reference to this incident, FBI Director Kash Patel claimed it is illegal to carry a gun at a protest.
"You cannot bring a firearm, loaded, with multiple magazines, to any sort of protest that you want. It's that simple. You don't have that right to break the law and incite violence," Patel said in an appearance on Fox News the day after federal agents killed Pretti.
Doar disagrees, saying that permit-to-carry holders have every right to carry a firearm at a protest.
"There's no prohibition in Minnesota statute that says you can't carry a firearm at a protest," he said.
WCCO has seen on many occasions permit-to-carry holders with long guns actively demonstrating for gun rights at the Minnesota State Capitol.
When a permit-to-carry holder interacts with law enforcement, they don't have to declare that they're carrying a gun unless law enforcement asks if they're carrying, Doar said. If they're asked, the holder must answer truthfully.
"But until they're asked, you're under no obligation to inform a peace officer. Interesting though is the statute uses the term 'peace officer', which, as defined in Minnesota statutes, doesn't include federal agents," said Doar."

It is illegal to carry concealed while committing a felony, which he was doing when he physically interfered with a ICE arrest of another individual.
The shooting will be a difficult investigation. I have watched several different angled videos of the shooting, and some make it look that ICE made a fatal mistake, other views seem to show it as a justified shooting.
 
How do you view these gatherings?
They are organized riots designed to push the limit right up to the use of deadly force by federal officers. They want physical interactions to try and portray officers as using brutal tactics for public opinion. It is working as you see some republicans softening on the issue. These people are smart, sinister, and manipulative; just like satan. They will eventually win as the Bible warns.
