Jury Orders Christian Clerk Pay $100k For Hurting The ‘Feelings’ Same-Sex Couple, Liberty Counsel Says

Former Rowan County Kentucky Clerk Kim Davis has been ordered by a federal jury to pay $100,000 in damages to a same-sex couple she refused to sign a marriage license for in 2015. Davis is represented by attorneys with Liberty Counsel, who plan to appeal the decision on her behalf.

The decision was made in court on Thursday, Sept. 14, when same-sex couple David Ermold and David Moore requested $50,000 each in damages. They claimed that Ermold had lost his job at the University of Pikeville as a result of the case with Davis. The University’s Director of Human Resources then testified that this claim was false and that Ermold’s position was one of several terminated due to downsizing. According to Liberty Counsel, Ermold and Moore then “changed gears during the trial to allege they should receive damages for hurt feelings.”

Liberty Counsel argues that evidence provided in court does not match the jury’s decision and, for that matter, did not even warrant being given over to the jury. As a result, they claim that the judge violated a rule of civil procedure by sending the case to the jury without sufficient evidence warranting damages. “Binding Sixth Circuit law states that the mere testimony of a plaintiff that he was embarrassed, humiliated, etc., without any other evidence of damages, cannot suffice to merit a damages award,” they state.

Ermold v. Davis is not the only case against Davis for her actions in 2015. Yates v. Davis, a similar case between Davis and same-sex couple James Yates and William Smith, was tried in tandem with Ermold. However, no damages were awarded in Yates because, in the words of Daniel Schmid, one of Davis’ attorneys, “that is what the evidence required.”

This is just a continued string of attacks biased against Christians and our biblical values.

Activists can burn down buildings, go to the homes of Supreme Court Justices and threaten their lives, assault those who don't agree with their agenda, but a blind eye is turned against these unlawful practices and no accountability for it.

But a Christian who is peaceful and hold to our God given rights and obedience to God's laws, that are supposedly protected under the first amendment of The US Constitution, pray silently in a Public place, and while most businesses can exercise the right to refuse service to anyone, a Christian business owner is penalized for exercising that same right.

This is an ongoing demonic attack on the Constitutional, and God given rights of Christians.

And because of where we are in these last days, just as God's Word has foretold, this Is not only expected, but will continue and result in Christian persecution.

But we are not forsaken by our Lord. These unrighteous acts of hatred towards Christians will be held accountable by The Highest Justice of All of Whose name we bear, Jesus Christ

Yes, it is. BUT...we cannot impose our values on the lost. God gives them a free choice, just as He gave us ... and still gives us. If our job is a secular job --especially in the public service-- I believe we need to perform that job properly, in EVERY way the job requires. And if there are aspects of the job that area repugnant to us because they violate our moral standards, then we need to find another job that doesn't.

True. We don't impose our values on the lost. We can't expect them to adopt biblical values.
But we don't accommodate or compromise to appease to their "values", either.
We shouldn't have to give up our faith based rights, because we are bullied into moving somewhere else or onto another type of business because others are offended.

**Take the example of the Colorado Christian Baker who has had multiple lawsuits against him for refusing to bake a same sex wedding cake.

He is more than willing to bake any cake for his customers. But his God given conscience won't allow him to use same sex images or decor on his custom cakes.

He's not refusing service to these customers who demand a same sex wedding cake, but this offends same sex customers.

This Christian Baker only refuses to accommodate the demand for him to customize a cake that represents an abomination to God. But has offered a basic cake without the representation of homosexuality. They refuse this and sue him for "discrimination".

A Christian is in this world, but not of the world.

The point I made in this article is that there isn't a balanced justice system. There's a two-tiered system that punishes one group of people vs no accountability for the other group that may do the same "offense" or far worse offenses, yet are not facing the same treatment that is imposed on Christians

I've yet to see a Muslim owned business get sued for not accommodating with Christian products in their business.

While we live peaceably in this world, we are obligated to take our stand for our faith, but do everything in a godly manner, in love for our neighbor.

The baker had his own business. He can make his own rules. The clerk worked for a govmint entity. The clerk is thus required to fulfill whatever the job entails in accordance with the law. If the law allows for two of the same gender to get a marriage license, then one should have been issued. If the clerk, due to faith, could not be a part of that, and I can certainly understand that, then the clerk should have resigned her position.

That said, a 100K judgement for hurt feelings that wasn't even proven seems quite excessive.

Respectfully, I think those examples are different. An independent business person is free to run their business in any way he or she desires. But working in the public service requires a person to perform all the required duties without fear or favor to ALL. If any part of that offends us, we should seek some other job.

As to the witch hunt against Christians, you are of course correct. Muslims have refused gay couples and not been sued. I suspect those gays have not died because they have been afraid of Islamic-approved violence...something they don't have to worry about with Christians. Besides, Satan doesn't care about other faiths, just the true one that glorifies God. Fortunately nearly all of the convictions in lower courts have been overturned at the highest level, showing that the justice system still works for Christians...though admittedly at a high cost.

I think my point is not being understood.

True, if a Christian "knowingly" takes a position that will compromise their faith, then yes, don't take that job, or when you find it is a confliction of our faith then indeed change your employment.

But as I am trying to emphasize is that first, we obey God as ruler rather than men. Acts 5:29.

A Christian can be placed in a position that we are in a public setting, we have the same rights as anyone.

But Christians are not being given those same rights.

If a Christian is employed where Everyone has certain rights, they should apply to Everyone.
But rather than engage in conflict, by all means remove yourself from that situation.

We are never called to offend anyone. A person can make up their own offense at any given time.

I live in an extreme far left Marxist agenda pushing state.
It hasn't always been this way.
But because the continuing imposed laws by the leftist majority in power in this state infringe on my faith, do I move to another state? I wouldn't.

Ify state imposes a lockdown again and tells me that I can't go to church or have a Bible study in my home, do I oblige and not take my stand for my faith and admonition to not forsake the gathering of ourselves?
I obey God as ruler rather than men.

I stay in California because in this majority ungodly state, Christians are the only light in this state and our presence gives hope to the unheard voices of people who want righteousness, that can only come from Jesus. We are the voices that defend the unheard and weaker.

"Defend the weak and the fatherless; uphold the cause of the poor and the oppressed.

I think what I am attempting to convey is being missed, but it's okay.

I did go further than just what the specific situation was about in the article.

If my point has been understood, Everyone, even in the Christian church, has the right to their opinion.

I'm not trying to be in disunion or impose my thoughts on anyone.
I am giving my scripture based opinion on the points I have made.
The point examples I gave did sidestep from the main point in the article. This may have led to confusion.

Nobody has to agree with what I say..
But I think either I am not making my point understood or it's just not being agreed with and that's okay.

Where are the real men (XY), with courage of conviction?

Maybe the churches, seminaries, and denominations are selecting, training, calling, and ordaining at least some poor choices for the office of Pastor :( Where are the Voters' Assemblies, Deacons, Elders, etc. to admonish and give the Pastor the ultimatum to properly shepherd, preach, and teach, or resign/get fired? In hierarchical denominations, where are the District and Denomination Presidents and staff to mentor, support, and develop the Pastors while they serve? Remove from rosters those, who should not be called because they cannot or will not properly carry out the duties of the office?

There will be a lot of people in Hell with burnt feelings because someone failed to hurt their feelings before it was too late :mad:

We, as Parishioners, also need to pray for the strength, courage, and protection of our Church leaders.
 
When man's "law" violates God's Law, there can be no comparison, nor can man's law be respected.

And we'd do well to ask ourselves who do we offend: man, or God.


Time to start asking ourselves whom we truly fear; if it isn't the Lord, then it's time to STOP calling ourselves "Christians", because WE DON'T DESERVE THE TITLE.

Is there some reason another clerk could not have done it?
 
The case hinged on 1st Amendment and "substantial and material" change in working conditions. Originally, when the law changed to allow same-sex "marriages," a clerk with conflicting deeply held religious beliefs could refuse, but another clerk in the office was to do it.

Later, there was more legislation from the bench regarding this case, and now there have been at least three different lawsuits stemming from the case, to include the (former) clerk's, and a judge has ruled a clerk cannot fail to issue.

This is a perfect example of why the political climate is important and should not be ignored by Christians. Christians have allowed our government to be taken over by liberal, atheistic, worldlings. I say 'taken over' because our country was once Christian. And every year we give up more ground to the secular atheists.

As a Christian we could once expect a fair hearing from our govenment which valued God, and the Bible. That is gone. Now the Christian is expected to obey the liberal atheists who despise God and the Bible. The Christian is expected to obey the perversions of the queers and perversions of the wicked, who only want to do it to display their superiority now over the Christian.

How many Christians want a queer or transexual to sign their marriage license? I don't know of any. But the queers and transexuals love to force a Christian to sign their marriage license, or force them to bake their cake. Domination.

This is the price we pay for not maintaining our Christian government given to us by God. The price we pay for thinking politics is not 'spiritual'. Politics is the area that Satan spends most of his time.

This is a recent article I posted under Evangelism.
It falls under the lines of your comment.
The church has been failing to stand up for biblical Truth and many churches have been silent giving the godless more Power to remove God out of everything.
Prophecy is unfolding with an increasing Apostasy but true believers are taking the fall and being persecuted for wanting to take our stand and remain unmovable with our faith.

I listen to Pastor Jack Hibbs. He's rather bold, much like Apostle Paul, I think, when it comes to being outspoken in defence of biblical Truth.

I agree wholeheartedly, Quantrill. This is the price that the Church has paid for not wanting to stand for the Lord; instead, we hid in the church buildings and thought it would "keep them out". Now, the churches are under siege and we find ourselves under assault from every direction.

In Ephesians 6, we are told after donning the Armor of God to "stand":

"Finally, be strong in the Lord and in the strength of His might. Put on the full armor of God, so that you will be able to stand firm against the schemes of the devil. For our struggle is not against flesh and blood, but against the rulers, against the powers, against the world forces of this darkness, against the spiritual forces of wickedness in the heavenly places. Therefore, take up the full armor of God, so that you will be able to resist in the evil day, and having done everything, to stand firm. I maintain that in the US, Canada, UK and Europe, many "christians" (an hour on Sunday with the other 6 days and 23 hours doing as the rest of the world) are not standing whatsoever. This leads me to ask the same question the Lord asked in Scripture:

"Now He was telling them a parable to show that at all times they ought to pray and not to lose heart, saying, “In a certain city there was a judge who did not fear God and did not respect man. There was a widow in that city, and she kept coming to him, saying, ‘Give me legal protection from my opponent.’ For a while he was unwilling; but afterward he said to himself, ‘Even though I do not fear God nor respect man, yet because this widow bothers me, I will give her legal protection, otherwise by continually coming she will wear me out.’” And the Lord said, “Hear what the unrighteous judge said; now, will not God bring about justice for His elect who cry to Him day and night, and will He delay long over them? I tell you that He will bring about justice for them quickly. However, when the Son of Man comes, will He find faith on the earth?”

The Lord Jesus asked us in Scripture to Count the cost; maybe we should start doing some counting here to see if we're really serious about paying that cost..

It's fun watching The Holy Ghost work in people. Even without talking to someone, he or she still gets The Gospel from whatever T shirt I'm wearing. Here, that seems to be the safest way for the muslim women to hear (see) The Gospel. Although, sometimes, I get to talk to someone.

It's funny dealing with the religious police in the muslim communities, here, too. There's not a lot they can do to me that hasn't already been done or tried :lol: Bonus, the longer they spend with me, no matter what/why/how, the longer they're exposed to text of John 3:16, text of John 14:6, a crucifix . . . most of the time they leave me alone, but they get most aggravated and aggressive if I'm out and about during a call to blasphemy, ignoring both the call and the "required" response :lol:

It's also fun watching people, including muslms, stop and stare at my lit-up giant Nativity or lit-up He is risen cross (Resurrection Sunday through Christmas decoration set-up day) in Dad's front yard :) If The Lord tarries and I get my own place again some day, I'll add religious Christmas carols and a tract holder/give-away box with a photo :D And a Little Free Library with Christian literature and assorted tracts and pamphlets, a cemetery bench with either a Bible verse or The Lord's Prayer, and a water bowl for dogs :) I saw someone else's similar secular set-up and it attracts more use than the "regular" house-on-a-stick-by-itself Little Free Library, so I figure a similar Christian set-up might encourage people to stop and browse/read for awhile, too.
