HUGE: Rep. Randy Fine Plans to Introduce Bill to Hold Judges Accountable for Releasing Violent Criminals to Reoffend

Rep. Randy Fine (R-FL) announced on Sunday that he is going to introduce legislation to hold soft-on-crime judges accountable if they release a violent criminal back to the street and the criminal commits more crimes.

The proposed legislation would “hold judges accountable when violent repeat offenders they release commit new crimes,” he said.

This comes after 34-year-old Decarlos Brown Jr. murdered 23-year-old Ukrainian refugee Iryna Zarutska last month by stabbing her multiple times in the Charlotte, North Carolina, light rail station.

Surveillance video from the incident shows Brown, unprovoked, stabbing Zarutska from the seat behind her on the light rail, then wandering around the rail car with what appears to be blood on the floor.

 
I hope this means that Judges won't start denying bail to everyone because of the potential for being held accountable for someone's actions, whom they don't even know, let alone can't control.

I hope this also means Parole Boards won't start automatically denying Parole to every inmate, who comes before them, because of the potential for case law precedent and/or new law holding them accountable for the actions of those, whom they release.

This kind of legislation could have some unfortunate, unforeseen consequences to the fairness and efficiency of the whole Judicial and Criminal Justice systems. A judge and/or Prosecutor may simply tell Law Enforcement they will not be entertaining anything for prosecution and adjudication, short of murder. Or Prosecutors may tell Law Enforcement agencies to not arrest until and unless a Warrant/True Bill (Grand Jury) is issued, and submit the paperwork for all such requests. The wheels of justice already move slowly; they'd likely grind to a halt. If this happens, at the same time, criminals would simply run amok because no consequences, not even the inconvenience of a night or two in jail.

Another unforeseen and unintended consequence is that the presumption of innocence would devolve from a cherished principle to "in-word-only" because innocent people would end up denied bail and spend long periods of time in jail, waiting for trial, so would be punished without due process, an egregious violation of 4th amendment rights. In a society, which persecutes Christians, this could have the effect of ridding society of anyone accused or even suspected of being a Christian.

Yet another, is could or would this spread to Defense Attorneys, who defended their clients "too well?"


This bill is an attack on Judicial Immunity, which is in place to ensure Judges can be impartial without fear of civil liability.

In places where Judges are elected, Judges not doing their jobs properly need to be recalled, Appointed Judges not doing their jobs properly need to be un-appointed. The latter poses problems with regard to balance of power between Executive, Legislative, and Judicial branches at all levels.


The bill, itself, would also be an attack on States' Rights and constitute a power grab by the Federal Government.
