BREAKING: Federal Judge Blocks Trump’s Executive Order on Birthright Citizenship Nationwide

The resistance has fired its first shot across the bow against President Trump courtesy of the Judiciary Branch.

As Newsnation reported, a federal judge for the time being blocked Trump’s executive order ending birthright citizenship regardless of the parent’s immigration status.

U.S. District Judge John C. Coughenour of Seattle ruled for open borders advocates in the case, which was brought by the states of Washington, Arizona, Illinois, and Oregon. These states claim the 14th Amendment and Supreme Court case law have cemented birthright citizenship even for the U.S.-born children of illegal aliens.

The case is just one of five lawsuits being brought by 22 states in total, along with a number of illegal alien advocate rights groups across America.

This does not surprise me. And I don't think it surprises President Trump or any of his people. It was to be expected. It will work its way through the courts, right up to the Supreme Court. Birthright citizenship needs to be adjudicated by that court. It is claimed it is guaranteed by the 14th amendment. Many legal experts disagree. So it needs to be settled once and for all.

I heard a good analogy: Birthright in America is like a woman 9 months pregnant visiting your home. And ends up having the baby in the middle of your living room floor. And then claims ownership rights of your house.
 
If this passes, what's to stop a government from stripping any of us, who were born here and are citizens, of our citizenship?

I understand the intent is to stop anchor babies and chain immigration, but ex post facto is a huge Constitutional issue, and I value my citizenship too much to risk losing it. This is a problem, whether this is intentional down the road when persecution of Christians happens, or an unintended consequence.

I was reading yesterday about an illegal immigrant pregnant woman who knew deportation was coming and looked to get an early delivery by Cesarean section so her baby would be born here so her baby would be a US born citizen before Trump's order to stop birthright citizenship takes effect.

The intent of the 14th amendment would prevent that happening. This amendment was passed in 1866 (and ratified 2 years later) in order to ensure that the freed slaves in America were not deprived of their citizenship by virtue of their ancestors having been born in Africa and brought to America as non-citizens. The wording of the amendment states that if the child was born in the United States it was an American citizen: but the context (and intent of Congress) made it quite clear that it was referring to the freed slaves. The fact that it not only conferred official American citizenship on these people federally but also bound the individuals states to this law by the words "nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws" helps confirm it's intent, for the Southern states bitterly resisted the idea that the former slaves could be considered citizens and given all the rights and protections that citizens enjoyed.

So, within the context of the above, the 14th amendment could never be used to deprive natural born Americans who are children of an American citizen or citizens of their birthright.

I am so looking forward to this case making its way to the Supreme Court. It will be an epic legal battle between those who understand why the fourteenth amendment was created and those who have twisted it to ensure that anyone born in the United States is a citizen regardless of parentage. It's a matter which is long overdue for judicial interpretation. Since the Supreme Court's job is to ensure that the Constitution is interpreted correctly as written and intended, it will be interesting to see how they rule on this matter. I am very much hoping that they will not rule expeditiously on this matter so as to avoid any upheaval in society, as the Supreme Court has done on occasion over the coutse of its existence, but rather will rule on the basis of pure law and the intent of Congress in enacting the 14th amendment.

It's going to be an exciting battle!
